The purchased Products will be delivered according to the specified terms and conditions, within the following indicative average timeframe: from approximately three working days from being dispatched for France to up to 2 weeks depending on the country.
Any delivery delay must be reported as soon as possible to the following address: customer-support@olislab.com.
Each shipping is deemed to have been carried out as soon as the Product(s) is/are made available to the Customer by the delivery service, as evidenced by the control system in place.
9. WHAT TO DO WHEN YOU RECEIVE YOUR ORDER: DISPUTES - INFORMATION
It is the Customer’s responsibility to immediately check the Products’ integrity and conformity upon receiving them, as well as the condition of their packaging.
In the event of a delay, breakage or missing Product(s), the Customer must express its full and precise complaints on the delivery slip upon receipt of the Product(s). In any event, the Customer may only take recourse against the carrier to whom he/she expressed their complaints. In case of missing Product or if the order has not been delivered after the specified delivery date, for any reason other than force majeure, the Customer must contact Oli’s Lab at the following address: customer-support@olislab.com.

You have fourteen (14) calendar days from the day following the delivery date of your order to notify Oli’s Lab of your intention to exercise your right of withdrawal.
Oli’s Lab will accept exchanges or returns of any Products sold on its Website provided that it has not been used, damaged or opened. For exchanges and returns, you have to send a notification of the exercise of your right of withdrawal (such notification to be sent to customer-support@olislab.com) and once the return authorization has been obtained, the Customer returns the Products to the Company at the address specified on the return authorization in accordance with the terms indicated. Oli’s Lab, upon receipt of the returned product, will carry on investigation as well as inspection of the returned product(s) to determine if anything restricts the possibility of return or exchange.
It is your responsibility to take care of the returned Product’s packaging.
The shipping cost for returning the Products is at the Customer’s expense, except in the event that the Products delivered would not conform to the order. Oli’s Lab does not accept parcels whose postage has not been paid.
All risks related to Product returns are at the customer’s expense. Oli’s Lab recommends that you choose an option with package tracking for returns to avoid any issues like loss or theft.
If the notification is not sent within the time limit stated above, your order will be considered final and no refund will be provided, except in other cases provided for in these Terms and Conditions of Sale.
If, however, all aforementioned conditions are met, Oli’s Lab will reimburse, via the same payment method initially used, any expenses incurred for the order of the returned Products, with the exception of the return costs, within a maximum period of fourteen (14) calendar days from the date upon which the return form and the returned Products have been received by Oli’s Lab.

11. WHAT LEGAL GUARANTEES DO YOU HAVE?
In Switzerland, electronic commerce (e-commerce) is mainly governed by the Federal Law Against Unfair Competition (LCD; RS 241) and the Order on the Indication of Prices (OIP; RS 942.211), and in the European Union by the Directive on Consumer Rights (Directive 2011/83/EU) and the Directive on Electronic Commerce (Directive 2000/31/EU).
Under Articles 184 et seq. CO, a sales contract can be entered electronically with just one click. The customer of Oli’s Lab can enter into a sales contract just by clicking on the “Confirm Order” button. Oli’s Lab and its clients must first agree on the essential points, i.e. the purpose of the sale, the purchase price and the making of the sales contract.
The non-binding provisions relating to the sales contract may be adapted individually, within the limits of the law. These changes can be set out by Oli’s Lab in the form of general terms and conditions of sale . These Terms and Conditions of Sale form an integral part of the contract once the buyer has been made aware of the Terms and Conditions of Sale before the contract is made and the buyer has had the opportunity to read and approve them.
Regarding the provisions of the Swiss Code of Obligations, the following points should be emphasized (with necessary adaptation on the grounds that Oli’s Lab is also servicing clients in the EU):
- Right of cancellation: In e-commerce, Swiss law does not provide for any withdrawal period or other right of return once the order has been placed however and as Oli’s Lab is also serving customers based in the EU, every customer can return a product within 14 calendar days of its receipt.
- Delivery times: Swiss law does not provide for any maximum delivery time. However, Oli’s Lab is serving customers in the EU therefore the maximum delivery time is set at a maximum of 30 calendar days for all orders processed on Oli’s Lab’s Website.
- Clear information: Oli’s Lab indicates on its website all the information stipulated in Art. 3 (1)(s) LCD (see next paragraph). Apart from Oli’s Lab contact details, the main characteristics of the product are indicated. The total price, inclusive of tax and fees, is also mentioned. Costs which cannot be calculated in advance are also indicated and the method of calculating prices is specified.
- Warranty: If a product presents a defect or does not offer the promised characteristics, the buyer has a minimum of two years to file a warranty action. The law provides for termination of the contract (Art. 208 CO) or refund of the decrease in value of the item sold (Art. 205 CO).
- Terms and Conditions of Sale (for EU clients): the consumer has the option of viewing and saving the Terms and Conditions of Sale when entering into a contract with Oli’s Lab.
- Order button: the button used on Oli’s Lab Website to place an order is featuring explicit wording and clicking the button means that the contract is entered into and payment becomes an obligation for the contract and related order to be performed.
The Federal Law Against Unfair Competition (LCD)
Art. 3 (1)(S) LCD defines the information which must be provided by Oli’s Lab:
“Anyone offering goods, work or services using electronic commerce without meeting the following conditions, is acting unfairly:
- indicate clearly and in full its identity and contact address, including e-mail,
- indicate the various technical steps resulting in the making of a contract,
- provide the appropriate technical tools making it possible to detect and correct entry errors before sending an order,
- Immediately confirm the customer’s order by e-mail.”
(1) Oli’s Lab states its company name, as listed in the trade register, its postal address and its e-mail address on the olsilab.com website and on terms and conditions of sale.
(2) clients must be able to clearly determine, throughout the order process, which stage of the order they have reached and they must know when they have finally entered into the contract by clicking on the “CONFIRM ORDER” button.
(3) It is possible for contract details to be checked and, if necessary, corrected by the customer before entering into the contract. The customer is able to view the contract they are entering into, particularly the quantity and type of product, the total order price and their billing/delivery details.
(4) The making and main elements of the contract are confirmed to the customer electronically.
Art. 8 LCD forbids the use of improper commercial conditions:
“Anyone using general terms and conditions which, in contradiction of the rules of good faith, provide, to the detriment of the consumer, for a marked and unjustified disproportion between the rights and obligations arising from the contract, is acting unfairly.”
Order on the Indication of Prices (OIP)
The Order on the Indication of Prices (OIP) applies to purchasing offers and offers comparable to a purchase which are made to consumers, and not business to business offers (B to B). It regulates the way in which prices must be indicated and everything which must be included in the price.
GOODS
For goods, Oli’s Lab indicates the actual price to be paid in Euros, including non-optional supplements of any kind (= retail price, Art. 3 and 4 OIP).
The price and all relevant information about the price are clearly visible and easily legible alongside the illustrated/described goods (Art. 7 and 8 OIP). The price appears in a font which is easily legible and clearly visible, in proximity to the product.
Non-optional supplements are included by Oli’s Lab in the price, as these are imperatively associated with the purchase of the goods and cannot be omitted.
Oli’s Lab indicates shipping costs separately, as these may vary depending on the size and destination of the order, but they are clearly visible and easily legible before concluding the contract.
Optional price supplements are indicated clearly and transparently. If they form an integral part of the contract, Oli’s Lab requires Customer to give their express consent to this.
Supplements for payment by credit card are optional price supplements.
ADVERTISING
When, in advertising, actual prices to be paid including all non-optional supplements are shown by Oli’s Lab.
The advertising offer is specified by Oli’s Lab: what the price relates to is clearly indicated. The goods and services are described using their essential criteria (brand, type, sort, etc.). The price therefore corresponds to the product photograph or description. For advertising distributed electronically by Oli’s Lab (e.g. on website home pages and banners, in e-mails or on smartphones), it is possible to link to Oli’s Lab’s website to provide details of the offer as long as Oli’s Lab’s Website is accessible with just one click.
12. LIABILITY
It is the Customer’s responsibility to judge the appropriate and suitable nature of the items he/she orders.
Oli’s Lab shall not be held liable for any use of the Products that does not conform to their intended use.
Oli’s Lab may not be held liable for total or partial non-fulfilment of its obligations, if this non-fulfilment is due to an act of God or if there is an occurrence of an element constituting force majeure. These events constitute a cause for suspension and/or termination of Oli’s Lab’s obligations to the Customer, without compensation to the Customer.
Oli’s Lab reserves the right to suspend the operation of the Website, and does not guarantee that the Website will be continuously available without temporary interruption, without suspension and without error.
13. HOW IS YOUR PERSONAL DATA PROCESSED?

Under these conditions, no person is authorised to reproduce, represent, exploit, adapt, distribute or use, by any process whatsoever, for any purpose whatsoever, in part or in full, these intellectual property rights, without the prior express written consent of Oli’s Lab.

The ombudsman's office will help you free of charge if, after shopping online, you have a complaint about a specific company that you were unable to resolve yourself or in a mutually satisfactory agreement.
You acknowledge that mediation is an out-of-court settlement of consumer disputes. If the conditions are met, a consumer mediation will take place according to a precise process and according to the rules in force. The procedure is free of charge for the consumer.
